Privacy Policy

1.     About this Policy

This privacy policy (the “Privacy Policy”) applies to all informationcollected or submitted when you install or use the KIPIT Application (“Application”).  It also applies to your use of the KIPITwebsite located at https://kipit.ai  (“Site” and collectively withApplication “KIPIT”). We want you to understand what types ofinformation we collect and what may happen to that information if you installand/or use KIPIT.

If we make materialchanges to this Privacy Policy that affect the way we collect, use and/or shareyour personal information, we will notify you by including an "Updated"label with the "Privacy Policy" on KIPIT for 30 days after materialchanges.  Forinformation on how to contact us if you ever have any questions or concernsabout our privacy policy, please contact us through the “Contact Us” tab on theSite.  

2.     Information We Collect

We have set out below the type of informationwe collect and how we collect it.  

  • Registration     Data.  In order to create a user account and use     KIPIT, you will be required to provide a name, password and valid email     address.  
  • Additional     Data.  If you contact us through the contact us     email, you may provide us with additional data.  The information you provide is at your     discretion.    
  • Collection     of Information from Use of KIPIT.  In addition to the information that you     provide to us when you register for a user account, we collect the     following information from your use of KIPIT. some text
       
    • Urls to web pages      that you save to KIPIT (“Links”).       It is rare for Links to contain personal data, and KIPIT      operates assuming that there is no personal data that can identify you or      any other identifiable person in Links saved by you to KIPIT. We recommend that you check to make      sure that any Links that you save to KIPIT do not contain personal data      which can identify you or any other identifiable person and that you do      not save any Links with personal data to KIPIT. These Links are not      treated by KIPIT as personal data.  
    •  
    • Your browser      type, device type, time zone, language, and other information related to      the manner in which you access KIPIT.
    •  
    • We also collect      information about your use of KIPIT so that we can provide our services.

3.    Use of Cookies andAnalytics

§  The Site uses GoogleAnalytics, a web analytics service provided by Google, Inc

§  Google Analyticssets a cookie in order to evaluate your use of the Site and compile reports forus on activity on the Site to help us understand how visitors engage with theSite and track visitor interactions. Google Analytics collects information withoutidentifying individual visitors.

§ Googlestores the information collected by the cookie on servers in the United States.Google may also transfer this information to third parties where required to doso by law, or where such third parties process the information on Google'sbehalf. Google Analytics uses its own cookies to store information, such aswhat time the visit occurred, whether the visitor has been to the Site before,and what Site referred the visitor to the web page. To disable this type ofcookie, some browsers will indicate when a cookie is being sent and allow youto decline cookies on a case-by-case basis. In addition to declining cookies,you can also install the Google Analytics Opt-out Add-on in your browser, whichprevents Google Analytics from collecting information about your Site visits.

4.    How we Use theInformation We Collect.

 

A.    Use of Information.  

     
  • Registration      Data: We will use the registration data in order to open an account for      you, respond to your requests, and perform our agreement with you.  
  •  
  • Use of      KIPIT Data. We will use information about your use of KIPIT in order to: create      reports for internal use to develop programs, products, services or      content, and provide aggregated information on how visitors use KIPIT,      such as "traffic statistics" and "response rates," to      third parties.
  •  
  • Links. We will aggregate      Links into a separate database. The Links once aggregated will not be      linked in such database to You.  We refer to such data base as      the “KIPIT Link Database”.  KIPIT will not be limited in any      way in its use of the KIPIT Link Database.  It might, for example, grant access to      third parties to the KIPIT Link Database, sell the KIPIT Link Database, or      provide statistical information to third parties based on the information      aggregated therein.  By using KIPIT, You grant Your consent, to the      extent required, for KIPIT to aggregate Links saved into KIPIT into the KIPIT      Link Database.   

B.     Legal basis forprocessing personal data

We process personal data for thepurposes set out in this Privacy Policy, as described above. We will onlycollect, process or share your personal data if we are satisfied that we havean appropriate legal basis to do this. Our processing is necessary for the purposes of legitimate interestspursued by us in order to: (i) perform our agreement with you; (ii) toevaluate, develop and improve KIPIT and other products; (iii) to prevent fraud;(iv) to protect our business interests; and (v) to ensure complaints areinvestigated.  It may be necessary toprocess your personal data to comply with a legal obligation. 

We may also use your personal data for purposes that arecompatible with the purposes we have described to you including archivingpurposes in the public interest, scientific research or statistical purposes,if permitted by data protection laws.

Wherewe have no other valid legal basis to process personal data, it will beprocessed based on your consent, which may subsequently be withdrawn at anytime by contacting us through the “Contact Us” tab on KIPIT. Withdrawal of your consent will not affect the lawfulness of processingbased on consent before its withdrawal, or processing that is being done on thebasis of other lawful grounds.   We would like You to know that once Links areaggregated as described above, it will no longer be possible to withdrawconsent with respect to Links already aggregated into the KIPIT Link Database.

5.     Your rights underlocal laws

Subject to certain exemptions, and insome cases dependent upon the processing activity we are undertaking, you mayhave, under certain applicable laws, some or all of the following rights inrespect to your Personal Information.  Wespecifically mention the General Data Protection Regulation (“GDPR”), aEuropean Union wide legal framework for the standardization of dataprotection.  If you are an EU resident,you should consult the GDPR for more information on your rights.  

§  Rightof Access: the right to beinformed of and request access to the personal data we process about you;

§  Rightto Rectification: the right torequest that we amend or update your personal data where it is inaccurate orincomplete;

§  Rightto Erasure: the right torequest that we delete your personal data where: (i) it is no longer needed forthe purposes for which it was collected, or; (ii) you have withdrawn yourconsent (where the processing of your personal data was based on consent);(iii) you have successfully objected (see right to object below); (iv) it hasbeen processed unlawfully. We are not required to comply with your request toerase personal data if the processing of is it necessary for compliance with alegal obligation or for the establishment, exercise or defense of legal claims.

§  Rightto Restrict: the right torequest that we temporarily or permanently stop processing all or some of yourpersonal data;

§  Rightto Object: the right toobject to your personal data being processed for direct marketing purposes and theright, at any time, to object to us processing your personal data which has ourlegitimate interests as its legal basis if you believe your fundamental rightsand freedoms outweigh our legitimate interests. If you raise an objection, wehave an opportunity to demonstrate that we have compelling legitimate interestswhich override your rights and freedom;

§  Rightto Data Portability: the right torequest a copy of your personal data in electronic format and the right totransmit that personal data for use in another party’s service; the right torequest a copy of your personal data in a structured, commonly used, machinereadable format, and the right to request that we transfer it directly toanother data controller, but in each case only where: (i) the processing isbased on your consent or on the performance of a contract with you; and (ii)the processing is carried out by automated means.

§  Rightnot to be subject to Automated Decision-making: the right to not be subject to a decisionbased solely on automated decision making, including profiling, where thedecision would have a legal effect on you or produce a similarly significanteffect.

If you wish to issue arequest to exercise your rights where applicable by law (whether located in theEU or elsewhere), please contact us on the Contact US tab on KIPIT. Pleaseprovide your name and contact information along with the request.  When we receive a request to exercise one ofthese rights, we will indicate what personal information we require from you tovalidate your identity. We will also provide information on the action weintend to take on the request without undue delay. Please note, these requestsare subject to applicable legal or document retention obligations imposed on us

6.     Sharing yourpersonal data

We do not share,sell, or otherwise disclose your personal data for purposes other than thoseoutlined in this Privacy Policy. However, we may disclose personal data that wecollect from you or that you provided to us to the following recipients for thepurposes described below:

§  Tocontractors, service providers, and other third parties we use to support ouractivities and who are bound by contractual obligations to keep personal dataconfidential and use it only for the purposes for which we disclose it to them,such as persons who perform maintenance on our computer systems or companiesthat assist us in processing transactions.

§  Wemay also share your personal information with a potential buyer of KIPIT or inconnection with (a) the sale, assignment, or other transfer of our business (orsignificant part thereof), in which case we will require any such buyer toagree to treat it in accordance with applicable data protection legislation; orwhen required by applicable laws, court orders, or government regulations.

§  Wemay also share tracking information with our marketing and advertisingpartners.

We take proper steps to ensure that recipientsof your personal data are bound to duties of confidentiality and we implementdata protection contractual clauses (to the extent required) to ensure that anytransferred Personal Data, remains protected and secure.

 

We will share the information in the KIPIT Link Database, asset forth in Section 3, and this will not be treated as personal data.

7.     Data Retention

In order for youto continue to use KIPIT, we will retain the registration data that you haveprovided to us.  You control when suchinformation is deleted.  If you enter the“Delete Account” tab on the Application, this will delete the information thatyou provided to us for registration.  Ifyou, however, delete the Application from your device, without entering “DeleteAccount”,  we do not know that you havedeleted your account, and the information that you provided to us will not bedeleted.  

We would like youto know for sake of completeness, that we do not delete the information in theKIPIT Link Database.

8.     Minors

KIPIT is notdirected at children.  We do notknowingly collect personal information directly from children (persons underthe age of 13, or another age if required by applicable law). However, we willcollect personal data regarding children from their parents or guardians (if itpertains to use of our product by a child).   If you are a parent or guardian of a childwho has provided personal information without your knowledge and consent, youmay request we remove this child’s information by emailing our PrivacyOffice by contacting us at the Contact Us tab on the KIPIT website.

 

9.    Links to Third Party Sites

At this point, we would also like toremind you we may provide additional links to resources we think you will finduseful.   These links will lead you tosites that are not affiliated with KIPIT and may operate under differentprivacy practices. You are responsible for reviewing the privacy policies forsuch other websites, as we have no control over information that is submittedto other sites.      

10.  Transfers of Datato a Different Geographic Region

Our Company is incorporated in Israel.  We use service providers whose computers andservers may be in various countries. Your information might end up on one ofthose computers in another country, and that country may have a different levelof data protection regulation than the protection in the country in which youare located. By giving us information, you consent to this kind of transfer ofyour information. No matter what country your information is in, we comply withthe law applicable to us and will also abide by the commitments we make in thisprivacy policy.

11.  Security

Wehave agreements with third parties and have adopted other security measures inplace to protect against the loss, misuse and/or unauthorized alteration of theinformation under our control or under the control of our service providers.Your personally identifiable information is protected by utilizing both onlineand offline security methods, including firewalls, passwords and restrictedphysical access to the places where your information is stored. Although we useindustry standard practices to protect your privacy, we do not promise, and youshould not expect, that your personal information will always remain free fromsecurity issues. In the event of a security breach involving your personalinformation, we will make any legally required disclosures to you in the mostexpedient time possible and without unreasonable delay, consistent with thelegitimate interests of law enforcement, or any measures necessary to determinethe scope of the breach and restore the reasonable integrity of the data system.
